Got a Traffic Ticket in Melbourne, FL? Here’s What To Do Next

A plain-English guide for Melbourne (Brevard County) drivers: where to pay, whether to fight it, whether traffic school can save your record, and when a lawyer is worth it.

The 30-second answer

You usually have four options: pay the fine, contest it yourself, take traffic school, or hire a lawyer. The right choice depends on whether it’s a moving violation and whether you have a good-driving record to protect.

1Where do I pay the ticket?

Never pay through a random site. Use the court’s official portal:

Your ticket names the court handling your case. If you’re not sure which court, use the official finder:

Melbourne details, verified against the Brevard County Clerk

  • Civil traffic infractions in Florida are not filed in a courtroom. They are handled by the Clerk of the Circuit Court for the county where you were cited, and the clerk's office is where the money and the paperwork go - Brevard County Clerk of Court and Comptroller.
  • You have 30 days to choose, and the three choices are: pay (that is an adjudication of guilt, with points on your Florida record), elect Basic Driver Improvement school (a 4-hour course; adjudication is withheld and no points are assessed), or request a hearing before a Traffic Hearing Officer to contest it. Doing nothing is not one of them.
  • Basic Driver Improvement is the Florida record-saver, but it has limits: you may elect it once in any 12-month period, it is not available to commercial driver's licence holders, and certain offences are excluded. The state's list of approved schools is at FLHSMV driver improvement schools.
  • Florida's point thresholds are statutory, not discretionary: 12 points in 12 months is a 30-day suspension, 18 in 18 months is three months, and 24 in 36 months is 12 months. You can see your own record through FLHSMV's driver licence check.
  • If you pay late you owe a late fee as well as the fine; a long enough non-payment can suspend your Florida licence and send the debt to the state's collection process, which adds a collection fee. Paying or electing school is always cheaper than ignoring the citation.
  • Many Florida counties can be paid through the state's county portal, MyFloridaCounty.com, which is a legitimate payment route operated for the clerks - and it is safer than any site that is not run by the clerk or the state.
  • Melbourne and the rest of Brevard County - Palm Bay, Cocoa, Titusville and the Space Coast - file traffic citations with the Brevard County Clerk of Court and Comptroller.
  • US-1, I-95 and the Beachline (SR-528) carry the enforcement, and a citation from Florida Highway Patrol or a Brevard sheriff's deputy goes to the same clerk as a Melbourne city ticket.
  • Brevard adds county surcharges to the statewide fine schedule, so the amount due depends on where in Florida you were cited. The clerk quotes the exact total for your citation number.
  • The 30-day election window is what creates your options: pay (adjudication plus points), elect the 4-hour Basic Driver Improvement course (adjudication withheld, once per 12 months, no CDL) or request a hearing before a Traffic Hearing Officer.

2How much will it cost?

In Florida the fine for a traffic infraction comes from a statewide penalty schedule plus county surcharges, and the total is printed on the citation the officer hands you. The clerk's figure is the real number - and if you pay late, a late fee is added on top.

Don’t just look at the fine. For a moving violation, the real cost is the fine plus the insurance increase, which can last up to three years. Florida adds 3, 4 or 6 points per moving violation and suspends at 12 points in 12 months, 18 in 18, or 24 in 36. Points stay on your record three years.

3Should I fight it, or just pay?

Answer three questions. There is nothing to type — no name, no citation number. We only record which options people choose (anonymously, so we know which cities and questions need work); the recommendation itself is calculated in your browser.

4Can traffic school save my record?

Florida lets you elect a 4-hour Basic Driver Improvement course to keep points off your record, generally within 30 days of the citation and once in a 12-month period. That election is the single biggest decision on a Miami moving violation.

5Do I need a lawyer?

For a simple moving violation a lawyer typically costs $250-$500 typical for a simple moving violation. It’s usually worth it when the insurance increase, or your job (CDL, company car), outweighs that fee.

6Do I have to show up in court?

It depends on the ticket. Many moving violations can be handled online or by mail; others require a court date. Check the court named on your ticket before the deadline — missing a deadline can add penalties or suspend your license.

Common questions

Will paying the ticket raise my insurance?

For a moving violation, usually yes — often for up to three years. Non-moving and parking tickets usually don’t.

What if I just ignore it?

Don’t. Unpaid tickets can lead to extra fines, a suspended license, or a warrant. Every option above is better than ignoring it.
